Las "Leyes Nuevas" del Emperador Carlos V: influencia de su espíritu proteccionista en el derecho laboral mexicano

Abstract

The primacy of state law, the preponderance of the codifi cation and the rise of liberal constitutionalism in the late nineteenth century, resulted in multiple transformations within the legal systems of the old Spanish-American kingdoms. And without doubt, one of the areas of law in which these changes were most intense, was in labor law. From these legal - historical coordinates, the author covers several dispositions that have regulated the pay to employees under the theory that the Spanish-American law, specifi cally with the enactment of the Leyes Nuevas, laid the groundwork for a protective system of the indigenous, which was neglected by the slogans of the liberal political philosophy; to be recaptured later with all its variations by the social constitutionalism emerged in Mexico in the early twentieth century.
