La formación de un lugar para la doctrina de la interpretación legal en el interior del sistema expositivo de la doctrina del derecho y de las codificaciones

Abstract

It is possible to identify a clear distinction in the systematic that is referred to the subject oflaw interpretation, about the manifestations of the codification process in both sides of theAtlantic. Thus, the French codificators dispose of a model already existent in al1 the codesand code projects composed in Europe in the second half of the XVIII century. But, it can beobserved a tendency to intervene in abstract, in the conception of the French codificators, somemodels of previous legal codes, which already reserved a certain section of the whole system,destined to the legal interpretation. The concrete model that intervened in the 1800 project,offered by Domat, orient us to the search of the mentioned abstract models, precisely in thedoctrine, the way is founded in the precedent of Domat, to the edge of the XVII century, whichis, a fifty years before the apparition of the first legal project of a code.
